It also focuses on the reoccurring issue of lifetime extensions of nuclear power plants (LTE). Similar approaches of the three legal frameworks Aarhus, Espoo, and Environmental Impact Assessment (EIA) Directive are highlighted.

A democratic nuclear energy transition: Public participation in nuclear activities
Download (pdf 938,1 KB)While participatory rights are gaining importance in the nuclear sector, nuclear-related activities have raised various questions in the practice of public participation under the Aarhus and Espoo Conventions. A recently published article by Priska Lueger and Leslie-Anne Duvic-Paoli analyses the interactions between international environmental law and international nuclear regarding environmental democracy principles in the context of nuclear activities.

ÖKOBÜRO statement on ACCC draft findings regarding Hinkley Point C
Download (pdf 206,4 KB)Environmental organizations are entitled to legal remedies against environmentally relevant decisions of the European Commission on state subsidies. This follows from the draft findings of the Aarhus Convention Compliance Committee (ACCC) on communication ACCC/C/2015/128 by ÖKOBÜRO and GLOBAL 2000 concerning the European Union. ÖKOBÜRO supports the ACCC's considerations and submitted some remarks.

Dezember 2020 fand die achte Vertragsstaatenkonferenz zum Übereinkommen von Espoo über die Umweltverträglichkeitsprüfung im grenzüberschreitenden Rahmen (Espoo Konvention) statt. Dabei beschlossen die Saaten insbesondere eine Guidance zur Anwendbarkeit der Konvention auf die Laufzeitverlängerung von Atomkraftwerken. ÖKOBÜRO brachte sich mit einem mündlichen Statement in die Diskussionen ein.

Joint NGO statement on draft LTE guidance
Download (pdf 792,2 KB)The Espoo Ad Hoc Group recently published a draft guidance on the applicability of the Espoo Convention to the lifetime extension of nuclear power plants.
Together with the Resource & Analysis Center “Society and Environment (RACSE), the European ECO Forum, ClientEarth and the European Environmental Bureau (EEB), ÖKOBÜRO submitted comments on this document to the Espoo Convention secretariat. The draft will be subject to discussion at the 9th meeting of the Working Group on Environmental Impact Assessment and Strategic Environmental Assessment. -

Lifetime Extension of Nuclear Power Plants - Analysis of Legal Aspects (2020)
Download (pdf 1,1 MB)As a targeted input to the ongoing ad hoc group’s work on the issue of NPP lifetime extension under the Espoo Convention, ÖKOBÜRO and the Resource & Analysis Center "Society and Environment" (RACSE) prepared a legal analysis. This paper includes an introduction to the issues of lifetime extension of nuclear power plant as such as well as of the different applicable legal frameworks. Focus is set on issues discussed within the ad hoc group, as well as on additional aspects the authors considered relevant.

EIA on Lifetime Extensions of Nuclear Power Plants after ECJ Judgement C-411/17
Download (pdf 1,0 MB)Planned Lifetime Extension (PLEX) or Long-Term Operation (LTO) of nuclear power plants is a sensitive issue within the European energy sector. This is due to the age of the operating reactors in conjunction with the near impossibility to construct and/or finance new reactors. It often seems easiest to continue the operation of old reactors as an existing electricity source. This paper was prepared as a targeted input to the ongoing ad hoc group’s work on the issue of NPP lifetime extension under the Espoo Convention in the light of recent case-law, especially ECJ case C-411/17. It aims at gaining better insight in the issue of carrying out obligatory environmental impact assessments (EIA) for operating nuclear reactors once they reached their design lifetime.
